Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you and LifeMaxxing (“LifeMaxxing”, “we”, “us”, or “our”) governing your access to and use of the LifeMaxxing mobile application, websites, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, our Community Guidelines, and our End User License Agreement. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age, or the minimum age of digital consent in your jurisdiction if higher, to use the Service. By using the Service, you represent and warrant that you meet this requirement and have legal capacity to enter into these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

LifeMaxxing is a location-anchored social application that enables users to log experiences (an activity together with a place or map pin and a date), follow other users, browse feeds and maps, and organise related content. The Service is designed for discovery and social recording of lived experiences. LifeMaxxing does not provide turn-by-turn navigation, emergency services, or professional advice of any kind.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law.

3. Accounts and security

• You must provide accurate information and keep it up to date.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• Notify us promptly at hello@lifemaxxing.com if you suspect unauthorised access.
• We may refuse registration, reclaim usernames, or require additional verification where reasonably necessary for security or compliance.

4. User content and experiences

“User Content” means any content you submit to the Service, including experiences, text, ratings, tags, comments, media, and profile information.

• Posts on LifeMaxxing must be genuine experiences consisting of an activity, a place or map pin, and a date.
• You retain ownership of your User Content. You grant LifeMaxxing a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, reproduce, adapt, publish, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Service, subject to your visibility settings.
• You represent that you have all rights necessary to submit User Content and that it does not infringe the rights of any third party or violate applicable law.
• We may remove or restrict User Content that violates these Terms, our Community Guidelines, or applicable law, or that we reasonably believe creates risk for the Service or other users.

5. Visibility and privacy controls

Per-experience visibility settings (such as public, followers, or private) are enforced on our servers. Delayed-publish or similar features may postpone when content becomes visible to others. You are responsible for choosing appropriate visibility settings before posting sensitive information.

6. Acceptable use

You agree not to:

• Harass, threaten, defame, or abuse others, or use location data to stalk or endanger any person.
• Post illegal content, hate speech, scams, spam, malware, or content that exploits or endangers minors.
• Impersonate others, misrepresent affiliation, or create fake engagement.
• Scrape, crawl, harvest, reverse engineer, or otherwise access the Service through unauthorised automated means.
• Interfere with or disrupt the Service, circumvent security or access controls, or overload our infrastructure.
• Use the Service for any unlawful purpose or in violation of our Community Guidelines.

7. Payments and subscriptions

Certain features of the Service may be offered free of charge. We may introduce paid features, subscriptions, or in-app purchases. Purchases made through the Apple App Store or Google Play are processed by the applicable platform operator and are subject to that platform’s payment terms, billing cycles, and refund policies. Except where required by applicable law or by the platform’s policies, fees are non-refundable for unused periods after a purchase is completed.

8. Intellectual property

The Service, including software, design, trademarks, logos, and branding, is owned by LifeMaxxing or its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms and the End User License Agreement, no rights are granted to you by implication or otherwise.

9. Third-party services

The Service may integrate or interoperate with third-party services, including sign-in providers, maps and places providers, hosting providers, and push-notification services. Your use of those services may be subject to their own terms and privacy policies. LifeMaxxing is not responsible for third-party services we do not control.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT USER CONTENT IS ACCURATE, COMPLETE, OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFEMAXXING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO LIFEMAXXING FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100), EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where such exclusion is unlawful.

12. Indemnity

You agree to indemnify and hold harmless LifeMaxxing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Suspension and termination

You may stop using the Service at any time and may delete your account as described on our Account Deletion page. We may suspend or terminate access, remove content, or restrict features if you breach these Terms or Community Guidelines, if required by law, or if reasonably necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive, including ownership, licence grants for content already distributed as permitted, disclaimers, limitations of liability, indemnity, and governing law.

14. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide that you may bring claims in your local courts under local law. Subject to those mandatory rights, the courts of the United Arab Emirates shall have jurisdiction to resolve disputes arising out of or relating to these Terms or the Service.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest revision. Material changes will be posted on this page and, where appropriate, notified through the Service. Continued use after the effective date of revised Terms constitutes acceptance, except where applicable law requires a different standard.

16. General

These Terms, together with the Privacy Policy, Community Guidelines, and End User License Agreement, constitute the entire agreement between you and LifeMaxxing regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganisation or transfer of the Service.
